1. General & Store Conditions
1.1 Agreement: These Terms & Conditions govern the use of molobeam.com and purchases made through the Molobeam online store. By accessing the website, creating an account, or placing an order, you agree to be bound by these Terms & Conditions.
1.2 South African Law: Molobeam operates within the Republic of South Africa and all transactions are subject to applicable South African law, including applicable consumer-protection legislation. Nothing in these Terms & Conditions is intended to limit or exclude any statutory right that cannot lawfully be limited or excluded.
1.3 Age Restriction: You must be 18 years or older, or have the required consent of a parent or legal guardian, to create an account and purchase products.
1.4 Product Information: Molobeam takes reasonable care to ensure that product descriptions, specifications, images, prices and availability displayed on the website are accurate. Product images may be illustrative and actual packaging, accessories, revisions or appearance may differ where the manufacturer has changed the product.
2. Pricing, VAT & Payment
2.1 Currency: All prices displayed on molobeam.com are in South African Rand (ZAR / R). Prices include VAT where applicable. Shipping and applicable delivery charges are calculated separately and displayed during checkout.
2.2 Pricing Errors: If an obvious pricing or product-description error occurs, Molobeam reserves the right to correct the error and, where necessary, cancel an affected order. If payment has already been received for an order that is cancelled because of such an error, the customer will receive a refund.
2.3 Payment: Orders are processed once cleared payment has been received through an authorised payment method. Available payment methods may include EFT, card payments and other payment methods made available by Molobeam from time to time.
2.4 Unpaid Orders: An order for which payment has not cleared may be cancelled after 3 business days.
3. Order Cancellation
3.1 Before Dispatch: A customer may request cancellation before the order has been packaged for dispatch or handed to the courier. Where cancellation is accepted before dispatch, Molobeam will refund the amount paid for the cancelled order.
3.2 After Dispatch: Once an order has been handed to the courier, it cannot normally be cancelled while it is in transit. The customer may instead follow the applicable return process after delivery.
3.3 Cancellation by Molobeam: Molobeam may cancel an order where payment has not been successfully received, the product is unavailable, an obvious pricing or product-description error occurred, fraudulent or suspicious activity is detected, the order cannot reasonably be fulfilled, or the product was incorrectly listed as available. Where Molobeam cancels an order after payment has been received, the amount paid for the cancelled order will be refunded.
4. Returns & Change-of-Mind Policy
4.1 30-Day Change-of-Mind Return
Molobeam offers a 30-calendar-day change-of-mind return period for eligible physical products, calculated from the date of delivery.
This is a Molobeam commercial return policy and is in addition to any statutory rights that may apply.
The product must generally be unused, in its original condition, in its original product packaging, accompanied by all accessories, manuals, cables, components and other supplied items, accompanied by applicable serial numbers, labels and identifying information, and suitable for resale.
The product should be securely packaged to prevent damage while being returned.
4.2 Opened or Handled Products
Change-of-mind returns are intended for products that can be returned in substantially the same condition in which they were supplied.
Where a product has been opened, used, assembled, configured, damaged or handled beyond what is reasonably necessary to inspect the product, Molobeam may reduce the refund where permitted by law to account for loss in value.
A reasonable restocking or handling charge of up to 15% may apply where the product or packaging has been materially handled or is no longer in resale condition, subject to applicable law.
4.3 Return Shipping for Change-of-Mind Returns
The customer is responsible for the cost of returning an unwanted product or a product ordered incorrectly, unless applicable law requires Molobeam to bear the cost. The original delivery charge is not automatically refundable for a voluntary change-of-mind return unless required by applicable law.
5. Damaged, Incorrect or Incomplete Orders
5.1 Damaged on Delivery
If a product arrives visibly damaged, the customer should notify Molobeam as soon as reasonably possible and preferably within 7 calendar days of delivery. Photographs of the external packaging, shipping label and damaged product may be requested to assist with the courier investigation. Where Molobeam accepts the return, the product may be collected and, depending on the circumstances and available stock, repaired, replaced or refunded.
5.2 Incorrect Product
If Molobeam supplies an incorrect product, the customer should notify Molobeam within 7 calendar days of delivery. Where the incorrect product is confirmed, Molobeam will arrange the appropriate return process and may provide a replacement or refund.
5.3 Missing Parts or Accessories
If an order is missing components, accessories or other items that were included with the product listing, the customer should notify Molobeam as soon as reasonably possible. Molobeam may request photographs or other information to establish what was supplied.
6. Defective Products & Warranty
6.1 Defective Products
A product that develops a qualifying defect may be returned for assessment. Where applicable under South African consumer-protection law, qualifying defective goods may be repaired, replaced or refunded. The applicable statutory rights are not excluded by this policy.
6.2 Six-Month Statutory Warranty
Where the Consumer Protection Act applies, customers may have statutory rights relating to defective goods for a period of six months from delivery. A returned product will be inspected and tested to establish the nature and cause of the reported fault. Where a qualifying defect is confirmed, the appropriate remedy will be provided in accordance with applicable law.
6.3 Testing and Assessment
Returned electronic products may require technical testing before a repair, replacement or refund is authorised. Testing may include power-on testing, functional testing, diagnostic testing, firmware or software testing, inspection for physical damage, inspection for liquid damage, inspection for electrical damage, inspection for missing accessories or components, and comparison of serial numbers and product identifiers.
Testing may take up to 10–14 business days where specialist assessment is required. Where a product must be assessed by a manufacturer, distributor or specialist supplier, the assessment period may be longer.
7. Electronics, Components & Development Boards
7.1 Electronic Components
Loose electronic components and modules may be excluded from Molobeam's voluntary change-of-mind return policy because of their sensitive nature and the difficulty of determining whether they have been electrically damaged after delivery.
This includes, but is not limited to, ICs, microcontrollers, sensors, development modules, breakout boards, PCBs, electronic components, connectors and similar components.
This exclusion does not remove any statutory rights relating to goods that were defective when supplied.
7.2 ESD Damage
Electronic components must be handled using appropriate ESD precautions. Damage caused by electrostatic discharge after delivery, incorrect handling, incorrect installation or improper storage may not qualify as a manufacturing defect.
7.3 Incorrect Wiring or Power
Damage resulting from reverse polarity, incorrect voltage, excessive current, incorrect wiring, short circuits, incorrect pin connections, inappropriate power supplies, electrical surges, or use outside the manufacturer's specifications may invalidate a warranty or return claim.
8. Warranty Exclusions
A warranty or defect claim may be rejected where inspection establishes that the fault or damage resulted from misuse, negligence, accident, unauthorised modification or another cause unrelated to a qualifying manufacturing defect.
Examples include:
- Physical impact or dropping.
- Liquid ingress.
- Corrosion.
- Electrical surges.
- Incorrect voltage.
- Reverse polarity.
- Incorrect wiring.
- ESD damage.
- Overheating caused by improper installation.
- Unauthorised firmware modification.
- Unauthorised hardware modification.
- Damage caused by accessories or equipment not approved by the manufacturer.
- Normal wear and tear.
- Use of the product outside its intended purpose or manufacturer's specifications.
Power fluctuations, electrical surges and load-shedding-related electrical events may therefore be excluded where they cause the damage.
9. Data-Storing Products
Customers returning products capable of storing personal information are responsible for removing their data before returning the product.
This includes, for example:
- SSDs.
- Hard drives.
- Computers.
- Laptops.
- Single-board computers.
- Development computers.
- Other storage-enabled devices.
Customers must remove passwords, account locks, activation locks and personal information where reasonably possible.
Molobeam is not responsible for loss of customer data during testing, repair, replacement or other handling of returned equipment.
Where a factory reset or other diagnostic procedure is required, stored information may be permanently erased. Customers should therefore maintain appropriate backups before returning a product.
10. Digital Products & Licence Keys
Digital products, downloadable software, electronic vouchers, licence keys and activation codes may not be eligible for change-of-mind returns once they have been downloaded, accessed, revealed or activated.
Unsealed software and activation products may likewise be excluded from voluntary returns.
This does not affect any statutory rights applicable to defective digital goods or services.
11. Specially Sourced & Imported Products
Products specially sourced, imported or ordered specifically at a customer's request may be excluded from Molobeam's voluntary change-of-mind return policy.
This may include products that Molobeam does not ordinarily hold in stock and obtains specifically to fulfil a customer's order.
Any applicable return restrictions will be communicated where reasonably possible before the order is placed.
This exclusion does not remove statutory consumer rights that cannot lawfully be excluded.
12. Bulk Orders
Bulk, trade or specially sourced orders may be subject to different return arrangements because products may be procured specifically to fulfil the order.
Where special return conditions apply, these will be communicated to the customer before the order is confirmed where reasonably practicable.
Statutory consumer rights remain unaffected where they apply.
13. Return Authorisation (RMA)
All returns should be authorised by Molobeam before being sent back.
Customers should contact support@molobeam.com with their order number, customer name, product name, reason for return, description of the fault or problem, and photographs or other evidence where requested.
Molobeam will provide return instructions and, where applicable, an RMA number.
Products should not be sent to an address other than the address supplied by Molobeam for the relevant return.
Unauthorised returns may be delayed while the order and return are identified.
14. Return Inspection
All returned products are subject to inspection.
Molobeam may refuse a voluntary change-of-mind return where the product:
- Is outside the applicable return period.
- Has been used.
- Is damaged.
- Is incomplete.
- Is missing accessories.
- Has missing serial numbers or identifying labels.
- Has been modified.
- Cannot reasonably be resold.
- Falls within an applicable non-returnable category.
Where a statutory defect claim is made, the product will be assessed to determine whether the claimed defect qualifies for a statutory remedy.
If a returned product is found to be fully functional and no qualifying defect is identified, Molobeam may return the product to the customer and may charge reasonable diagnostic and return-delivery costs where permitted by law.
15. Refunds
15.1 Refund Method
Where a refund is approved, Molobeam will normally refund the amount through the original payment method. Where the original payment method cannot reasonably be used, Molobeam may request verified banking information or another appropriate refund method.
15.2 Refund Processing
Refunds are processed after the returned product has been received and assessed where assessment is required. The time for the funds to reflect in the customer's account may depend on the payment provider and banking institution.
15.3 Replacement
Where a replacement is agreed upon and stock is available, Molobeam may replace the returned product. If replacement stock is unavailable, an appropriate refund or other remedy may be provided.
16. Extended & Manufacturer Warranties
Some products may carry manufacturer, distributor or extended warranties beyond the applicable statutory period.
Where a product is covered by such a warranty, Molobeam may assist the customer in submitting a warranty claim to the relevant manufacturer, distributor or authorised service centre.
The manufacturer or distributor may need to inspect and approve the claim. Additional manufacturer warranty terms may apply.
17. Privacy & POPIA
Molobeam collects and processes personal information required to process orders, payments, returns, refunds, customer support and deliveries.
Personal information is processed in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act (POPIA).
Information may be shared with payment providers, couriers, logistics providers, manufacturers or authorised service providers where reasonably necessary to fulfil an order, process a return or provide customer support.
18. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable South African law.
Subject to applicable law, Molobeam will not be responsible for losses arising from a customer's misuse, unauthorised modification, incorrect installation, incorrect electrical connection, failure to follow manufacturer instructions, or failure to maintain appropriate backups of personal data.
19. Changes to These Terms
Molobeam may update these Terms & Conditions from time to time.
The version applicable to an order is generally the version in effect when the order was placed.
The current version will be published on molobeam.com.
20. Governing Law & Consumer Complaints
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Customers are encouraged to contact Molobeam first so that complaints, returns and disputes can be resolved directly.
Where a matter cannot be resolved directly, the customer may pursue any applicable remedy or escalation available under South African law, including referral to the appropriate consumer-protection authority.
21. Governing Law
Governed by South African law. Escalations may be referred to the National Consumer Commission (NCC).
